Abstract

Philosophical discussion seems to take place in an impersonal space, and legal philosophy is a subfield of philosophy. Legal philosophy has a crucial role in how Indonesian legislation is created. Considering the idea in Islam that just judgements or punishments, aside from being directly tied to people, are also related to the Creator (Allah SWT), law also applies in the hereafter. Therefore, in addition to adhering to the direct rules (or heavenly laws in the case of Islam) of God's revelation in the form of holy books, mankind must constantly seek out formulas of truth that are dispersed across society, namely a law that will drive society's direction and a law that will govern individual behavior. More research must be done on the legal theory. This page seeks to explain what legal philosophy is, why it's beneficial to study it, and how Islamic legal philosophy differs from other legal systems.
